滙護康服務條款與細則

歡迎使用滙護康平台(下稱「本平台」、「我們」)。本條款與細則(下稱「本條款」)構成用戶與本平台之間的合法協議,適用於所有訪問及使用本平台之人士,包括護理服務員、護理需求者及接受護理者(合稱「用戶」或「您」)。


 

透過註冊、登入或使用本平台,即表示您已閱讀、理解並同意遵守本條款。若您不同意本條款的任何內容,請立即停止使用本平台。


 

一、平台性質與使用目的


 

1.1 本平台為一個護理服務連接平台,旨在協助護理需求者與合資格之護理服務員建立初步聯繫。


 

1.2 本平台僅提供資訊展示與聯絡渠道,不參與、仲介、推薦或管理用戶之間的護理服務協議或醫療照護安排。


 

1.3 所有護理服務安排均屬用戶雙方之私人協議,本平台對任何合約內容、履約情形或爭議概不負責。


 

二、註冊與帳戶


 


 

2.1 使用本平台之部分功能需先註冊帳戶。註冊人必須年滿18歲並具備完全法律行為能力。


 

2.2 護理服務員註冊時須提供真實之身份與專業資料,包括但不限於:姓名、註冊編號、聯絡資料、工作經驗、證書等。本平台保留隨時查核資料真偽之權利。


 

2.3 護理需求者註冊時須提供基本資料(如姓名、出生日期、聯絡方式),以便進行聯絡配對及服務查詢。


 

2.4 所有用戶應妥善保管登入憑證,不得轉讓或與他人共用帳號。


 

三、用戶責任


 

3.1 用戶承諾使用本平台時不得從事以下行為:


 

  • 提供虛假或誤導性資訊;

  • 冒充他人或虛構身份;

  • 擅自訪問他人帳號或系統;

  • 散播惡意、歧視、誹謗或淫穢內容;

  • 利用本平台從事非法、欺詐或違反倫理之行為。


 

3.2 本平台保留隨時暫停或終止違規帳戶之權利,無須事先通知。


 

四、平台服務內容


 

4.1 本平台提供護理服務員名錄展示、搜尋功能及初步聯絡工具(如留言或電子郵件轉介)。


 

4.2 本平台不進行服務內容之媒合、安排或管理,亦不承擔任何監督、保證或推薦責任。


 

4.3 本平台不涉醫療建議。所有醫療相關事項應由用戶與專業醫療人員另行磋商。


 

五、訂閱與付款


 

5.1 免費試用期:護理服務員首次註冊可獲得一個月免費試用期,僅限一次。若違規重複註冊,本平台有權終止所有帳戶。


 

5.2 收費計劃:


 

  • 每月方案:每月GBP £30,兩個月為一期計費;

  • 每年方案:每年GBP £360,額外贈送一個月免費使用期。


 

5.3 付款方式:接受信用卡、Apple Pay、Google Pay、PayPal與銀行轉帳。


 

5.4 退款政策:所有訂閱費用一經支付,恕不退款。用戶應於付款前審慎評估是否需要續用服務。


 

六、私隱與資料保障


 

6.1 我們會根據《個人資料(私隱)條例》(香港法例第486章)蒐集、儲存與處理您的個人資料。


 

6.2 本平台僅於提供服務所需範圍內使用資料,並採用Wix提供的安全技術加以保護。


 

6.3 除非獲得用戶明確同意,我們不會向第三方出售或分享您的資料。


 

七、知識產權


 

7.1 本平台所有內容(包括但不限於文字、圖像、標誌、圖示、介面設計、AI生成圖像)均為滙護康或授權方之財產。


 

7.2 未經書面授權,用戶不得擅自下載、複製、修改、散佈或商業使用任何內容。


 

八、用戶產生內容


 

8.1 用戶可提交意見或建議,並同意本平台可於平台中轉載或引用相關內容。


 

8.2 我們保留刪除任何虛假、侮辱性、誤導性或違法內容之權利,無須另行通知。


 

九、責任限制


 

9.1 本平台對下列情況不承擔任何法律責任:


 

  • 本平台服務暫停或技術中斷所導致之任何損失;

  • 護理服務員資料之準確性、完整性或真實性;

  • 任何基於用戶間協議而產生之爭議、損害、索償或延誤。


 

9.2 用戶同意使用本平台風險自負,並應自行承擔服務合作相關法律風險與後果。


 

十、爭議處理


 

10.1 本平台不介入用戶間之任何護理安排、付款爭議或合約糾紛。


 

10.2 所有相關爭議應由用戶雙方協商處理,必要時由香港法律機構介入。


 

十一、帳戶終止


 


 

11.1 如我們合理懷疑用戶提供不實資料、涉及詐騙、違反法律或專業規範,有權即時終止其帳戶而無須預先通知。


 

11.2 若護理服務員因專業失當而遭有關機構暫停或取消執業資格,本平台有權移除其帳戶資料並禁止其繼續使用平台服務。


 

十二、條款更新


 

12.1 我們可隨時修訂本條款,修訂版本一經上載即時生效。重大變更將以電郵通知所有註冊用戶。


 

十三、年齡限制


 

13.1 本平台僅供年滿18歲人士使用。不接受任何未成年用戶註冊或使用本平台,即使有家長或監護人同意亦不例外。


 

十四、不可抗力


 

14.1 因天災、火災、政府政策、電訊故障、黑客攻擊、戰爭、疫情或其他非本平台控制因素所導致之服務中斷或資料遺失,我們將不承擔任何賠償責任。


 

十五、法律適用與管轄


 


 

15.1 本條款受香港特別行政區法律管轄,所有相關爭議應提交香港法院解決。

NetusCare Terms and Conditions

Welcome to NetusCare. These Terms and Conditions (“Terms”) govern your access to and use of the NetusCare platform (“the Platform”, “we”, “us”, or “our”). These Terms form a legally binding agreement between the user (“you”) and NetusCare.


 

By registering for an account, browsing, or otherwise using our services, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree to any part of these Terms, you must cease using the Platform immediately.


 

1. Nature and Purpose of the Platform


 

1.1 NetusCare is a digital platform designed to connect Care Providers and Care Seekers in Hong Kong.


 

1.2 The Platform provides an online directory and messaging tools to facilitate initial contact. It does not intermediate, manage, recommend, or control any private care agreements or healthcare arrangements between users.


 

1.3 All care services are entered into voluntarily and privately between users. The Platform bears no responsibility for any service terms, outcomes, or disputes arising therefrom.


 

2. Account Registration


 

2.1 Certain functions of the Platform require account registration. All users must be at least 18 years of age and have full legal capacity.


 

2.2 Care Providers must provide accurate and verifiable information, including but not limited to: full name, registration number, contact details, work experience, certifications, and a description of offered services.


 

2.3 Care Seekers must provide basic contact information (such as full name, date of birth, and email) for inquiry and communication purposes.


 

2.4 Users are responsible for securing their login credentials. Sharing or transferring accounts is strictly prohibited.


 

3. User Responsibilities


 

3.1 All users agree not to:


 

  • Provide false or misleading information;

  • Impersonate another person or entity;

  • Access others’ accounts or platform systems without authorization;

  • Distribute harmful, offensive, or inappropriate content;

  • Use the Platform for any unlawful, fraudulent, or unethical purposes.


 

3.2 We reserve the right to suspend or terminate any account found to be in violation of these Terms without prior notice.


 

4. Services Provided


 

4.1 The Platform offers access to a directory of Care Providers, a search function, and messaging tools to facilitate initial contact.


 

4.2 We do not arrange or oversee care services, and we do not verify, guarantee, or endorse any service providers or agreements.


 

4.3 The Platform does not provide medical advice. All health-related matters should be addressed directly with licensed medical professionals.


 

5. Subscription and Payment


 

5.1 Free Trial:

Newly registered Care Providers are eligible for a one-time one-month free trial. Abuse of the trial through duplicate or fraudulent accounts is strictly prohibited.


 

5.2 Subscription Plans:


 

  • Monthly Plan: £30 GBP/month, billed every two months

  • Annual Plan: £360 GBP/year, with one additional month free


 

5.3 Payment Methods:

We accept credit/debit cards, Apple Pay, Google Pay, PayPal, and bank transfer.


 

5.4 Refund Policy:

All payments are non-refundable. Users are advised to review the subscription terms carefully before proceeding.


 

6. Privacy and Data Protection


 

6.1 We comply with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong in collecting, storing, and processing personal data.


 

6.2 Data collected will only be used for the purpose of service delivery and account management. All data is securely stored using Wix infrastructure.


 

6.3 We do not share or sell user data to third parties without explicit user consent.


 

7. Intellectual Property


 

7.1 All content, including text, graphics, logos, icons, and AI-generated images, is owned by NetusCare or licensed to us.


 

7.2 Users may not copy, distribute, modify, or commercially exploit any content on the Platform without written permission.


 

8. User-Generated Content


 

8.1 Users may submit comments or suggestions, which we may display or quote at our discretion.


 

8.2 We reserve the right to remove any content that is false, defamatory, misleading, or violates applicable laws.


 

9. Limitation of Liability


 

9.1 NetusCare shall not be liable for:


 

  • Any interruptions or technical failures of the Platform;

  • Inaccuracies or incompleteness in user-submitted profiles;

  • Disputes, damages, or losses arising from user-to-user agreements.


 

9.2 Users accept full responsibility and assume all risks for any private care arrangements made via the Platform.


 

10. Dispute Resolution


 

10.1 The Platform does not intervene in or resolve any disputes between Care Providers and Care Seekers.


 

10.2 All such disputes should be resolved directly between the involved parties. Legal recourse should be sought in accordance with Hong Kong law if necessary.


 

11. Account Termination


 

11.1 We reserve the right to suspend or permanently remove any account found to contain false information, engage in fraudulent activity, or violate professional standards.


 

11.2 If a Care Provider is suspended or deregistered by a relevant licensing body, their account may be removed from the Platform.


 

12. Amendments to Terms


 

12.1 We may update these Terms at any time. Updated versions will take effect upon publication. Significant changes will be communicated via email to registered users.


 

13. Age Restriction


 

13.1 The Platform is only available to users aged 18 and above. We do not permit minors to register or use the Platform under any circumstances, even with parental consent.


 

14. Force Majeure


 

14.1 We are not liable for service disruptions caused by events beyond our control, including but not limited to natural disasters, governmental actions, telecommunications outages, war, or pandemics.


 

15. Governing Law


 

15.1 These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. All disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
